Both CaseLink Web and CaseLink Office were updated last month in conjunction with updated dollar amounts in Title 11 and Title 28, which became effective on April 1, 2016, and will apply to cases commenced on or after that date.

The new wage claim cap limit updates were proposed by the Judicial Conference of the United States pursuant to the automatic three-year adjustment required by 11 U.S.C. §104. Seven official Bankruptcy Forms (106C, 107, 122A-2, 122C-2, 201, 207, and 410) and two Director’s Forms (2000 and 2830) have been amended to reflect the adjusted dollar amounts, as follows:

Old New
507(a)(4) Priority claim cap – Wages $12,475  $12,850
507(a)(5)(B)(i) Priority claim cap – Employee benefit plan $12,475 $12,850

The updated dollar amounts have been published in the Federal Register and may be accessed here.
